CNBC News: Was Hurd losing his edge anyway?

Hewlett-Packard CEO Mark Hurd unexpectedly resigned on Friday after a sexual harassment probe found he had a "close personal relationship" with an HP contractor who received improper payments.






The shocking announcement from the world's top personal computer maker sent its shares plunging 10 percent as Hurd is one of the most admired chief executives in Silicon Valley and credited with reviving the company after the tumultuous reign of Carly Fiorina.

HP's stock lost $9.0 billion in market capitalization in after-hours trading, tumbling to multi-year lows.
The company said one of its former contractors, involved in marketing activities from late 2007 to the fall of 2009, had levied sexual harassment allegations at Hurd.
HP said Hurd, who is 53 and married, had a "close personal relationship" with the contractor. An investigation found no violation of HP's sexual harassment policy, but did find that Hurd violated standards of business conduct, HP said.
There were instances where the female contractor received compensation or reimbursement without a legitimate business purpose, HP said.
A source familiar with the situation told Reuters that Hurd never had sex with the woman and that the expense account issues stretched over two years and amounted to no more than $20,000.
"The board investigation found that Mark demonstrated a profound lack of judgment that seriously undermined his credibility and damaged his effectiveness in leading HP and Mark agreed," HP General Counsel Mike Holston said.
Hurd will be replaced by Chief Financial Officer Cathie Lesjak on an interim basis. Lesjak has taken herself out of consideration as the permanent CEO, HP said.
Hurd said the decision to step aside was a "painful" one.
"I realized there were instances in which I did not live up to the standards and principles of trust, respect and integrity that I have espoused at HP," Hurd said in a statement.
Hurd will be well compensated as he departs HP. An SEC filing examined by CNBC indicated that Hurd is contractually entitled to $52.9 million in the event of a resignation.
The filing, dated 2009, says that total is composed of $11.6 million in cash, with the remainder in stock options and restricted stock.
A source close to Hurd put his current severance at about $40 million.
News of the shake-up stunned the technology world. HP is the largest technology company in the world on a revenue basis, and is a major player in personal computers, servers, services and printers.
"Shock and puzzlement, that's how it's going to go down," said Russell Hancock, president and chief executive of Joint Venture Silicon Valley, an area business group. "There wasn't anybody who criticized his handling of the company."
The buttoned-down Hurd brought stability to HP after Fiorina resigned in February 2005 in the wake of a controversial deal to acquire PC maker Compaq.
"Mark Hurd was extremely instrumental in turning this company around," said Susquehanna Financial Group analyst Jeffrey Fidacaro. "There's going to be a serious gap in leadership at the top of this company."
HP, a Silicon Valley icon that was founded in a Palo Alto garage in 1939, has experienced a fair amount of turmoil in recent years. In 2006, former HP Chair Patricia Dunn resigned after reports surfaced that the company had hired private investigators to spy on board members and journalists to plug media leaks.
A Succesful Tenure
Shares of HP have more than doubled since Hurd, the former CEO of NCR Corp, took the helm five years ago, cutting costs and expanding HP's footprint in the services market with acquisitions like the 2008 purchase of EDS Corp for $13.9 billion.
In a bid to reassure investors that its financials are healthy despite the departure of Hurd, HP raised its outlook for the full year, saying it now expects profit, excluding items, of $4.49 to $4.51 per share, compared with a previous outlook of $4.45 to $4.50.
HP said its board of directors has formed a search committee to find a new chief executive and board chair.
"It's a negative because the positive leadership that HP has had under Hurd is identified with his name," said Nehal Chokshi, an analyst with Technology Insights Research-Southridge Research Group.
HP, which was scheduled to report quarterly earnings later this month, also pre-reported its results.

HP CEO Mark Hurd Resigns; CFO Cathie Lesjak Appointed Interim CEO; HP Announces Preliminary Results and Raises Full-year Outlook

PALO ALTO, Calif. -- HP today announced that Chairman, Chief Executive Officer and President Mark Hurd has decided with the Board of Directors to resign his positions effective immediately.
The Board has appointed CFO Cathie Lesjak, 51, as CEO on an interim basis. Lesjak is a 24-year veteran of the company who has served as HP’s CFO and as a member of the company’s Executive Council since January 2007. She oversees all company financial matters and will retain her CFO responsibilities during the interim period.
Hurd’s decision was made following an investigation by outside legal counsel and the General Counsel’s Office, overseen by the Board, of the facts and circumstances surrounding a claim of sexual harassment against Hurd and HP by a former contractor to HP. The investigation determined there was no violation of HP’s sexual harassment policy, but did find violations of HP’s Standards of Business Conduct.
A Search Committee of the Board of Directors has been created, consisting of Marc L. Andreessen, Lawrence T. Babbio, Jr., John H. Hammergren, and Joel Z. Hyatt, which will oversee the process for the identification and selection of a new CEO and Board Chair. HP’s lead independent director, Robert Ryan, will continue in that position.
Hurd said: “As the investigation progressed, I realized there were instances in which I did not live up to the standards and principles of trust, respect and integrity that I have espoused at HP and which have guided me throughout my career. After a number of discussions with members of the board, I will move aside and the board will search for new leadership. This is a painful decision for me to make after five years at HP, but I believe it would be difficult for me to continue as an effective leader at HP and I believe this is the only decision the board and I could make at this time. I want to stress that this in no way reflects on the operating performance or financial integrity of HP.”
“The corporation is exceptionally well positioned strategically,” Hurd continued. “HP has an extremely talented executive team supported by a dedicated and customer focused work force. I expect that the company will continue to be successful in the future.”
Robert Ryan, lead independent director of the Board, said: “The board deliberated extensively on this matter. It recognizes the considerable value that Mark has contributed to HP over the past five years in establishing us as a leader in the industry. He has worked tirelessly to improve the value of HP, and we greatly appreciate his efforts. He is leaving this company in the hands of a very talented team of executives. This departure was not related in any way to the company’s operational performance or financial condition, both of which remain strong. The board recognizes that this change in leadership is unexpected news for everyone associated with HP, but we have strong leaders driving our businesses, and strong teams of employees driving performance.”

Lesjak has taken herself out of consideration as the permanent CEO but will serve as interim CEO until the selection process is complete. Candidates from both inside and outside the company will be considered. The selection of a new chairman will occur in conjunction with the CEO decision.
The company does not expect to make any additional structural changes or executive leadership changes in the near future.
HP announces preliminary third quarter results; raises full-year outlook for revenue and non-GAAP EPS
HP is announcing preliminary results for the third fiscal quarter 2010, with revenue of approximately $30.7 billion up 11% compared with the prior-year period.
In the third quarter, preliminary GAAP diluted earnings per share (EPS) were approximately $0.75 and non-GAAP diluted EPS were approximately $1.08. GAAP and non-GAAP EPS were negatively impacted by $0.02 pertaining to one-time charges relating to the previously announced U.S. Department of Justice settlement. Non-GAAP diluted EPS estimates exclude after-tax costs of approximately $0.33 per share, related primarily to restructuring, amortization of purchased intangible assets and acquisition-related charges.
For the fourth fiscal quarter of 2010, HP estimates revenue of approximately $32.5 billion to $32.7 billion, GAAP diluted EPS in the range of $1.03 to $1.05 and non-GAAP diluted EPS in the range of $1.25 to $1.27. Non-GAAP diluted EPS estimates exclude after-tax costs of approximately $0.22 per share, related primarily to restructuring, amortization of purchased intangible assets and acquisition-related charges.
For the full year, HP now expects revenue in the range of $125.3 billion to $125.5 billion. FY10 GAAP diluted EPS is expected to be in the range of $3.62 to $3.64 and non-GAAP diluted EPS in the ranged of $4.49 to $4.51. FY10 non-GAAP diluted EPS estimates exclude after-tax costs of approximately $0.87 per share, related primarily to restructuring, amortization of purchased intangibles and acquisition-related charges.
HP plans to release its final results for the third fiscal quarter on Thursday, Aug. 19, 2010, with a conference call at 6 p.m. ET/3 p.m. PT to provide additional details.

Microsoft slates record-setting monster Patch Tuesday next week - Computerworld




14 updates, 8 critical, will quash 34 bugs in Windows, Office, IE, Silverlight



Computerworld - Microsoft today said it will deliver a record 14 security updates next week to patch a record-tying 34 vulnerabilities in Windows, Internet Explorer (IE), Office and Silverlight.
But people still running Windows XP Service Pack 2 (SP2) will receive only a few of those fixes.
"Call it Massive Patch Tuesday," said Wolfgang Kandek, CTO of security risk and compliance provider Qualys. "It's a huge update, and more importantly, everybody's involved. I'm actually a little surprised at how large it is."
Eight of the 14 updates were tagged with Microsoft's "critical" label, the highest threat ranking in its four-step scoring system. The remaining six were marked "important," the second-highest rating.
Next week's Patch Tuesday will be a record on several fronts.
The 14 updates -- Microsoft dubs them "bulletins" -- are a record, beating the count from both February 2010 and October 2009 by one. The 34 individual patches equals the single-month record, which was first set last October and repeated in June 2010. And the eight critical updates next week will also tie the record set in October 2009.
Microsoft has been shipping alternating large and small batches of fixes, with the larger-sized updates landing in even-numbered months, so the month's big numbers shouldn't have come as a complete shock. In July, for example, the company issued just four bulletins that patched five vulnerabilities. June's collection, however, amounted to 10 bulletins that fixed 34 flaws.
IE is also patched on an every-other-month schedule. Microsoft last fixed IE flaws in June.
"This is big, not only because of the numbers, but also because they'll affect everybody," said Kandek, referring to next week's lineup.
According to Microsoft's monthly advance notification, the company will deliver 10 updates for Windows, half of them critical, the other five rated important. Two updates will patch one or more critical bugs in IE and Silverlight, while another pair affect Office.
All currently-supported versions of Windows are impacted by multiple updates, Microsoft said, with Windows XP Service Pack 3 (SP3), the oldest edition that receives patches, affected by all five Windows-only critical updates, as well as by the critical IE and Silverlight fixes.
Nor will Windows 7 escape next week: Two of the five critical Windows updates apply to the newest operating system, as do the critical IE and Silverlight patches. Windows 7 will receive at least 10 of the 14 planned updates.
The Office updates are aimed at flaws in Word and Excel, and affect all versions of the word processor and spreadsheet with the exception of those in Office 2010. Both updates also apply to the Mac editions of Word and Excel, said Microsoft.
"A large month was expected," said Kandek, "but my main worry now is for Windows XP SP2 users who haven't upgraded."
Last month, Microsoft retired Windows XP SP2 and Windows 2000 from "extended support," which means security patches will no longer to crafted or supplied for those operating systems.
Microsoft made that clear earlier this week when it released an emergency, or "out-of-band" update, to quash a critical bug in Windows shortcuts that hackers have already used to hijack PCs, including machines in multiple companies that oversee important industrial control systems. It did not provide a patch then for XP SP2.
Although Microsoft's policy prevents it from confirming whether unsupported software contains vulnerabilities, it's likely that XP SP2 harbors the same bugs as XP SP3, which will be patched next week.
"All of those for XP SP3 are quite probably also in XP SP2," said Kandek.
Not only will Microsoft not offer the applicable Windows updates to PCs running XP SP2, but it will also deny those machines the critical IE update.
The Office updates may be delivered to users running Windows XP SP2, however; Microsoft evaluates Office's patching needs using the version of the suite running on the system, not on the operating system.
"There's no free pass just because Windows Update doesn't offer you patches," said Kandek, talking to XP SP2 users, who might think they're safe because they won't see any updates offered on Tuesday.
Qualys has offered users of obsolete operating systems a hand by testing some exploits against out-of-support versions of Windows. The companypublishes the results on its Web site.
"We'll continue to do this to substantiate our suspicion that [XP SP2] is very vulnerable now that it's not being patched," said Kandek."

HP eStation Zeen a tablet? windows 7, webos or android?

For me it is clear a tablet PC as you can see on the second image here posted as 9. DUT Testing position
but the report issue date is July 30,2010, so unless these guys who made the tests used to mention as a tablet PC like a tablet computer instead, it could be built in with  any OS, because HP got FCC approvation for the HP slate windows 7 almost a year ago. By the other way is it something that HP just have to change in the windows 7 slate and needed a new FCC approval?

You can read the adobe files on this FCC link. Give us your opinion and if you are an electronic engineer the better. There are a lot of significant electronic test made that you might understand better than me.

Engadget has been recalling a post that they published back in December 2009, when the talked about HP filing a new trademark “Zeen,” which was said to be a portable handheld device. Back then we assumed that it was just an eReader, but now that name has been upgraded to the HP eStation Zeen and looks to be their new Slate device.
This is a bit of a stretch surmising this, but all the signs are there, as a recent FCC filing shows that the device comes with 802.11b/g/n WiFi. Thomas Ricker from the gadget blog believes that this is the fabled HP Slate, but there are still a number of questions that needs answering.
We know that it is a tablet, so we would like to know which OS will it run webOS, Android orWindows 7? The smart money would be on webOS, considering Hewlett Packard now owns Palm. However, maybe they would not want to spend time and effort on such a task, when Google and Microsoft already has an operating system in place that will work with these new tablet PCs.
So we have established that it is a tablet, but we have no idea on a price, OS, specs, design or anything else. I know, we are not much help, but we will keep you updated. What OS do you think HP should go with, Android, webOS or Windows 7?
